Please read this Privacy Policy carefully before using the ag-analytics.org, analytics.ag or related website or the Ag-Analytics mobile application (together, or individually, the "Service") operated by Ag-Analytics Technology Company ("Ag-Analytics", "us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with this Privacy Policy. This Privacy Policy applies to all visitors, users and others who wish to access or use the Service. If you disagree with any part of this Privacy Policy then you do not have permission to access the Service.

We may revise, add to or otherwise update this Privacy Policy periodically in the future in our sole discretion by posting the new Privacy Policy on our website with an effective date indicating when the revised Privacy Policy will take effect. You should review this Privacy Policy periodically, as your continued use of the Service after we post any revisions, additions or updates to this Privacy Policy will constitute your consent to be bound by the new Privacy Policy. If you do not agree to any revision, addition or update to this Privacy Policy, you should not access or use our Service.

In connection with the Service, we may collect the following categories of information:

• information related to your farm or other property (e.g., fields, field locations, agronomic data, Geographic Information System (GIS) precision farm data and sensor data, farm productivity and business data, and precision agriculture data including harvest, seeding, tillage, and application operation data);
• information regarding your use of the Service; and
• any other information that you provide or otherwise make available to us in connection with the Service.

You may choose not to provide certain information to us, but as a result you may not be able to take advantage of some of the features of the Service.

We may also collect general, non-personal, statistical information about the use of the Service automatically, such as how many visitors visit a specific webpage, how long a visitor stays on that page, and the hyperlinks visitors click. We collect this information by using cookies, log files and other similar technologies (as further described below in the section of this Privacy Policy entitled ‘Cookies, Log Files and Similar Technologies’). This information represents a generic overview of visitors and users of our Service.

We may use the information that we collect in order to:

• where permitted by applicable law or when the disclosure is necessary, in our discretion, for the establishment or maintenance of legal claims or legal compliance, to satisfy any law, regulation, subpoena or government request, or in connection with litigation; or
• as otherwise disclosed in this Privacy Policy.

Additionally, in the event we are acquired by, or merge or consolidate into, another entity, or if there is a sale of our assets (including in bankruptcy), your information may be transferred to the entity acquiring us or our assets or that survives the merger or consolidation. You acknowledge and agree that in the foregoing circumstances, your information may be disclosed to such third party.

We may use cookies, log files and similar technologies to collect certain information regarding your use of the Service. A cookie is a small amount of data that is sent to your browser from a website’s servers and stored on your computer’s hard drive which often includes an anonymous unique identifier. Cookies do not identify specific users, only a user’s device. We use cookies to track and record user session information. You may set your browser to notify you when you receive a new cookie or to disable cookies. However, this may impact the performance of the Service, and/or prevent you from using certain features of the Service.

The Service also may use log files. The information inside the log files includes internet protocol (IP) addresses, type of browser, Internet Service Provider (ISP), date/time stamp, referring/exit pages, and number of clicks to analyze trends, administer the site, track a user’s movement around the Service, and gather demographic information.

In addition to our own cookies, log files and similar technologies, we may engage third parties (e.g., Google) to use their cookies, log files and similar technologies to report to us usage statistics of the Service, deliver advertisements on and through the Service, and for other similar purposes. Google Analytics, for example, uses cookies to track your interactions with our Service. Google collects information and reports it to us, without identifying individual users. We use a variety of security technologies and procedures to help protect your information from unauthorized access, use, or disclosure. For example, all personal information in production systems is encrypted behind a Secure Sockets Layer and stored in a secure cloud. However, since no method of electronic storage is 100% secure, we cannot guarantee the absolute security of the information stored. We also cannot guarantee that information you supply will not be intercepted while being transmitted to us over the Internet.

Our Service is not directed to children. Nonetheless, if we inadvertently collect information from children 13 years of age or under, their parents always may review, or request that we delete their child’s information, or refuse to permit the further collection or use of it.

Our Service is intended for individuals located in the United States. If you are located outside of the United States and access the Service, or submit your information to us, you do so at your own risk and choice. United States law may not offer the same privacy protections as the law of your jurisdiction. If you visit our websites or use our Service or contact us from outside of the United States, please be advised that (i) any information you provide to us or that we automatically collect will be transferred to and processed in the United States; and (ii) by using our Service or submitting information to us, you explicitly authorize its transfer to and subsequent processing in the United States in accordance with this Privacy Policy and United States law.

At this time, we do not respond to browser 'Do Not Track' signals.

California Civil Code Section 1798.83 (California’s "Shine the Light" law) permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. In addition to any other applicable provisions of this Privacy Policy, if you are a resident of California, you may have additional rights pursuant to the California Consumer Privacy Act of 2018 (the "CCPA"), as amended by the California Privacy Rights Act (the "CPRA"), as applicable and when in effect. This section describes those rights and how to exercise them. As used in this section, the term "personal information" has the same meaning as given to such term in the CCPA but does not include information derived from public records (i.e., ‘publicly available information’ or information that is lawfully made available from federal, state, or local government records, such as plat maps and land ownership records).

In addition to the information set forth in the section above entitled "Information We Collect", the table below sets forth (1) the categories of personal information we may have collected with respect to California residents, (2) the sources from which such information was may have been collected, and (3) the business purpose which may have been used for such collection, in each case within the last twelve (12) months.

Sharing Personal Information. We may share your personal information as described above in the section entitled "How We Use Your Information".

Sale of Personal Information. In the preceding twelve (12) months, we have not sold any categories of personal information; however, with your consent we do share this information with lender, real estate and other partners and in some cases may receive a commission or other remuneration for doing so.

Your Rights Under the CCPA. Pursuant to the CCPA, you have the right to know:

• the categories of personal information that we have collected about you;
• the categories of sources from which the personal information is collected;
• our business or commercial purpose for collecting or selling your personal information;
• the categories of third parties with whom we share personal information (if any); and
• the specific pieces of personal information that we have collected about you.

In connection with any personal information we may sell or disclose to a third party for a business purpose, you also have the right to know:

• the categories of personal information about you that we sold and the categories of third parties to whom such information was sold; and

You have the right to request the deletion of your personal information from our records and those of our service providers, unless an exception applies under the CCPA. You also have the right to request that we correct any inaccurate personal information, taking into account the nature of such personal information and the purposes of the processing of such personal information.

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

• charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
• provide a different level or quality of goods or services to you;
• suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services; or
• retaliating against an employee, applicant for employment, or independent contractor for exercising their rights.

Exercising Your Rights. To exercise your rights described above, please submit a request by either calling us at 1-866-AGLAND1 or emailing us at support@acrevalue.com. Your request must:

• provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
• describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Additionally, if you request specific pieces of your personal information or the deletion of certain personal information, you may be required to provide a signed declaration under penalty of perjury and otherwise authenticate your identity.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may only submit a request to know twice within a 12-month period.

Requests by Authorized Agents. You are permitted to designate an authorized agent to make a request on your behalf. Your authorized agent can use the methods described above to submit the request and will be required to provide proof of authorization.
